Terms of Service

1. Acceptance of Terms
By accessing or using the Hackhouse platform at community.hackhouse.africa(the “Platform”), operated by Hackhouse Africa Limited (“Hackhouse”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform.
2. The Platform
Hackhouse is a community platform for event listing, management, resources, and merchandise, centred on Hackhouse Africa, 124 Manyani East Road, Nairobi. The Platform allows organizers to create communities, publish events, sell tickets, and manage attendees. It allows attendees to discover events, follow communities, register, purchase tickets, read blog content, and buy merchandise from the Hackhouse shop.
A 2.5% ticketing fee applies to all paid ticket sales on the Platform: 1.5% covers Paystack payment processing and 1% is the Hackhouse platform fee. The fee is deducted automatically before settlement to the organizer. Free events have no fees.
3. Accounts
You must provide accurate, current information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Organizer accounts are available to persons aged 18 and above. Attendee age requirements are determined by each event organizer.
4. Event Organizers
- Organizers are solely responsible for the content, accuracy, and legality of their event listings, including descriptions, pricing, and imagery.
- Payments are processed through Hackhouse’s central Paystack account. Each organizer is assigned a Paystack subaccount linked to their bank details. Ticket revenue (minus the 3% ticketing fee) is settled automatically by Paystack to the organizer’s bank account.
- Organizers are responsible for fulfilling their event commitments, issuing refunds where appropriate, and complying with all applicable Kenyan laws, including consumer protection and data protection regulations.
- Organizers must not use the Platform to promote events that are unlawful, fraudulent, harmful, or violate any third-party rights.
- By collecting follower data (name, email, phone) through communities, organizers become independent data controllers under the Kenya Data Protection Act, 2019 and must handle such data in compliance with the Act.
5. Attendees
- By registering for an event or purchasing a ticket, you enter into a direct transaction with the event organizer, not with Hackhouse.
- Hackhouse is not liable for the quality, safety, or occurrence of any event listed on the Platform.
- Tickets are subject to the organizer’s refund and cancellation policies. See our Refund Policy for platform-level guidelines.
6. Payments
All ticket payments are processed through Hackhouse’s central Paystack account. By making a payment, you agree to Paystack’s terms of service. Hackhouse does not store credit card numbers, M-Pesa PINs, or other payment credentials.
- A 2.5% ticketing fee is deducted from each paid ticket sale: 1.5% Paystack processing fee and 1% Hackhouse platform fee. The organizer receives 97.5% of the ticket price.
- Settlement is automatic - Paystack settles the organizer’s share directly to their bank account on Paystack’s standard settlement schedule.
- Refunds are processed in accordance with our Refund Policy. The 3% ticketing fee is non-refundable.
- Payment disputes should be directed to the event organizer in the first instance.
7. Venue
All in-person events listed on the Platform take place at Hackhouse Africa, 124 Manyani East Road, Nairobi. The maximum venue capacity is 140 persons. Organizers and attendees must comply with all venue rules, safety regulations, and any applicable public health directives.
8. Shop & Merchandise
- The Hackhouse shop sells branded merchandise (apparel, accessories, and other goods) directly to buyers. All shop purchases are transactions between the buyer and Hackhouse Africa Limited.
- Product descriptions, images, and prices are as accurate as reasonably possible. Minor variations in colour may occur due to screen differences.
- Prices are quoted in Kenya Shillings (KES) and are inclusive of VAT where applicable.
- Shop payments are processed through Paystack. Hackhouse does not store card numbers or M-Pesa PINs.
- Orders are fulfilled within the timeline stated on the product page. If an item is out of stock after purchase, we will notify you and offer a full refund or a substitute of equal or greater value.

9. Intellectual Property
The Hackhouse name, logo, and branding are the property of Hackhouse Africa Limited. Event content (descriptions, images) is the property of the respective organizers. By uploading content to the Platform, organizers grant Hackhouse a non-exclusive, royalty-free licence to display that content on the Platform for the purpose of promoting the event.
10. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable Kenyan law.
- Impersonate another person or misrepresent your affiliation with an organization.
- Attempt to gain unauthorized access to any part of the Platform.
- Scrape, crawl, or harvest data from the Platform without written consent.
- Sell counterfeit or unauthorized tickets to events listed on the Platform.
11. Limitation of Liability
To the maximum extent permitted by Kenyan law, Hackhouse shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of the Platform, including but not limited to loss of profits, data, or business opportunities.
Hackhouse’s aggregate liability for any claim arising from these Terms shall not exceed KES 10,000.
12. Termination
Hackhouse may suspend or terminate your access to the Platform at any time for violation of these Terms or for any reason with reasonable notice. You may delete your account at any time through the account settings.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of Kenya. Any disputes arising from the use of the Platform shall be resolved through mediation in Nairobi. If mediation fails, disputes shall be submitted to the courts of Kenya.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the Platform or email at least 14 days before they take effect. Continued use constitutes acceptance.
